Promotional vouchers may be subject to additional, individual terms and conditions. These will be communicated to you directly in connection with the voucher.

7.1.2.2 Vouchers that you have received as a new customer by invitation from a Westwing Member (so-called "Refer a Friend Voucher") cannot be redeemed if you already have an account with Westwing, as the voucher can only be redeemed for new customers.

7.1.2.3 Vouchers for the first registration or for new customers that you receive for registering on the www.westwing.sk website can only be redeemed once per customer account.

7.1.2.4 Only one promotional voucher can be redeemed per order. It is not possible to refund or credit the balance of the promotional voucher if the value of the purchase is less than the value of the voucher.

7.1.2.5 The Promotional Voucher is non-transferable, non-refundable and non-redeemable if you return goods or services that you have paid for in whole or in part with the voucher on the basis of a statutory right of withdrawal. If you return ordered goods on a pro rata basis, the value of the voucher will be divided in proportion to the goods ordered, i.e. in the case of returning individual items, the voucher will be credited in proportion to the price of the returned goods and its validity will expire in proportion to the value of the goods. If the voucher is tied to a minimum order value, it must be retained even in the event of a partial return, otherwise the voucher value will not be credited.

7.1.3 Compensation vouchers

In the latter case, you have the right to cancel the order.

7.3 It is not possible to redeem the voucher, nor to transfer its value or to subsequently use the voucher to pay for purchases already made, i.e. after the completion of the order process.

7.4 The above vouchers can only be redeemed by consumers.

8. DELIVERY AND SHIPPING CONDITIONS

8.1 Service takes place only within Slovakia to the delivery address provided by you.

8.2 Basic delivery times will be communicated to you on the relevant goods page.

8.3 The ordered goods will be sent as a package or via a carrier at Westwing's discretion.

8.4 Westwing does not assume any purchase risk (i.e. does not assume responsibility for the delivery of goods by suppliers), in particular in the case of a generic purchase (i.e. the purchase of goods that are not branded or customized for the consumer). Westwing is obliged to deliver goods only from its existing stock of goods or the actual delivery of goods ordered from suppliers. Westwing is not obliged to deliver the goods if, despite an existing cover transaction with the relevant supplier, Westwing does not receive the ordered goods at all, in full or on time. If such a situation arises, Westwing will inform you immediately. Westwing will refund all advance payments.

8.5 Westwing shall not be liable for the non-performance or inadequate performance of the obligations assumed by Westwing under this Agreement, if and to the extent that this is due to the occurrence of force majeure, without prejudice to the fact that Westwing will make every effort to limit the consequences of such an event as much as possible.

Force majeure means any unforeseeable events or events that are beyond Westwing's control, even if foreseeable, and the impact on the performance of the contract could not have been prevented by Westwing even if reasonable efforts had been made. This includes, but is not limited to, war, state of war, insurrection, insurrection, military or civil coup, riot, riot, embargo, government regulation, fire, flood, storm surge, hurricane or other adverse weather conditions on the scale of a disaster, earthquake, lightning strike, pandemic, epidemic, nuclear hazard or similar cause beyond Westwing's control that makes the performance or compliance with obligations under these GTC unlawful, impossible or commercially unfeasible. Westwing is exempt from the obligation to perform for the duration of this event. Delivery and fulfillment deadlines will be extended accordingly. If the force majeure lasts longer than 8 weeks, Westwing and you have the right to withdraw from the contract.

8.6 If the delivery of the goods fails for reasons for which you are responsible, Westwing will charge you the cost of a new delivery as well as reasonable storage costs from the date of the failed delivery. You will be charged for the cost of a new delivery even if the first delivery was free of charge for you. We will inform you of the additional costs before the new delivery and will only carry out the delivery with your consent. Please note that refusal to accept is not an effective exercise of your right of withdrawal and must be expressly notified to Westwing. Westwing reserves the right to withdraw from the contract if you do not agree to a new delivery within 7 days. In this case, Westwing will refund all payments you have already made. This also applies if you actually exercise your right of withdrawal. In this case, you will also be reimbursed for the shipping costs (standard shipping).

9. WARRANTY, LIABILITY AND DAMAGE IN TRANSIT

9.1 Unless otherwise specified in the following provisions, the provisions on statutory liability for defects apply.

9.2 If the goods are delivered with obvious damage to the packaging or contents, notify the relevant delivery company immediately and contact Westwing Customer Service (service@westwing.sk). Reporting does not affect your warranty rights, but it makes it easier for Westwing to make claims against the delivery company.

10. WARRANTIES

An additional contractual warranty is only provided if it is expressly stated and described on the product information page.

11. CONSUMER'S RIGHT OF WITHDRAWAL

You have the right to withdraw from any contract with Westwing within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the date on which you or a third party other than the carrier designated by you took over the goods.

12. CONSEQUENCES OF WITHDRAWAL

If you have withdrawn from the purchase contract, we will refund to you all payments received from you, including delivery costs, without delay, no later than fourteen (14) days from the date on which we received the notice of withdrawal. We will use the same means of payment that you used for the original transaction to refund your money, unless we expressly agree otherwise with you. There will be no fee for this refund in any case. We may hold refunds until we have received the goods back or you have provided us with proof that you have returned the goods, whichever comes first.

You must return the goods immediately and in any event within fourteen (14) days from the date on which you informed us of the withdrawal to the following address:

Westwing GmbH

Westwing European Logistics Center, Stachowska 17C, 62-023 Robakowo, Poland

The deadline is maintained if you ship the goods before the expiry of the 14-day period. The cost of returning the goods is borne by us. You only have to pay a depreciation if the depreciation is due to the handling of the goods that is not necessary to examine the condition, characteristics and functionality of the goods.

The right of withdrawal does not exist or expires in the case of the following contracts:

in the case of a supply of goods which are not suitable for return for reasons of health or hygiene protection and the protective packaging of which has been broken after delivery or which, by reason of their nature, may be inseparably mixed with other goods after delivery;

for the supply of goods manufactured to the customer's specifications or clearly tailored to personal needs;

in the case of delivery of goods which may perish rapidly or the expiry date of which would be rapidly exceeded;

13. VOLUNTARY RIGHT OF CONSUMERS TO RETURN GOODS

13.1 For all purchases of goods, Westwing grants you a voluntary right of return within a total period of 30 days from receipt of the goods in addition to the statutory right of withdrawal under Section 11. This voluntary right of return gives you the opportunity to withdraw from the purchase contract even after the expiry of the 14-day withdrawal period (see point 11) by returning the goods to Westwing within 30 days of receipt.

However, the condition for exercising the voluntary right of return is the return of the complete goods in flawless condition and without damage in the original sales packaging. Otherwise, Westwing reserves the right to refuse returns. Please note that when returning goods under a voluntary right of return, you bear the risk of shipping. The voluntary right of return does not apply to the purchase of gift vouchers.

13.2 Refunds will be made to the same means of payment as you used to make the payment. If direct debit has been selected as the means of payment, you do not have to object to the direct debit.

13.3 Your statutory right of withdrawal (see Section 11) is not affected by the fulfilment of the requirements set out in this Section 15 and shall continue to apply independently of them. Until the expiry of the period for exercising the statutory right of withdrawal, only the legal conditions set out therein apply. This contractually granted (voluntary) right of withdrawal does not limit your statutory warranty rights, which remain unlimited.

14. REIMBURSEMENT OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL WITHDRAWAL

If you cancel the contract for only part of the goods from the order (partial cancellation), Westwing will refund the payments for the goods to which the cancellation relates, including the costs of delivery and assembly (if they have not already been assembled). However, if the delivery and assembly costs (or part of them) were to be incurred even if you only ordered goods for which you did not cancel the contract, these costs are excluded from the refund.

15. RESERVATION OF TITLE

The goods remain the property of Westwing until full payment.
